Lusaka High Court Announces its Verdict on Portland Cement Zambia

Dr. Rajan Lekhraj Mahtani is a noted businessman from Zambia. He is among the top entrepreneurs in Zambia with numerous successful business ventures under his name. Despite his successful business career as well as philanthropic activities, he is always targeted by conspirators and people who would like to see him fail. Even the government and laws of Zambia have failed to provide proper justice for businessmen like Dr. Rajan Mahtani. This can be easily seen from the case of Portland cement Zambia, which Dr. Mahtani has been fighting for almost 10 years.

During this period of 10 years, several evidences have been submitted by Dr. Rajan Mahtani and his lawyers that prove his claim over the factory. A signed shareholder’s agreement was shared in which all critical shareholding members of the Portland cement factory agreed that Dr. Mahtani was the legal owner of the factory. Financial exhibits were shared which clarified his investment of almost USD 12 million in the factory for asset management and enhancing the productivity of the factory. Another critical report which proved Dr. Mahtani’s claim was the independent audit report conducted by an independent auditor. In this unbiased report, it has been clearly mentioned that the Portland Cement Zambia factory was established as a joint venture and Dr. Mahtani is the sole joint venture partner of the factory. All these evidences together with testimonials from important members of the factory were more than enough to prove Dr. Mahtani’s claim and win him this case.

The judge handling this case recently announced closure of case hearing, giving relief to Dr. Mahtani as it was a sure win with the evidences his lawyers had submitted. However, the judgement given by the Justice can be easily considered as misdirected as none of the evidences were taken into consideration while giving the final verdict. While the verdict was against Dr. Mahtani, he has not considered this as a defeat and has again appealed to the higher court of law against the Lusaka High Court judgment.
